Legal Right To Act on Your Own Behalf
No one has the right to lay claim to human remains. However, provincial statute allows certain people or agencies to act on your behalf.
Before death, the decision is yours or your appointed Power of Attorney. After death, it is the responsibility of your executor(s), appointed legal representative or legal next of kin. An EXECUTOR has ultimate authority and can overrule a spouse or legal next of kin. When there is no will or family, a legal representative, such as the Public Trustee or Social Services, has the legal right to act on your behalf even if they have not been made aware of your wishes as they will be assuming the financial responsibilities.
No one has the right to direct your remains to any funeral service provider, except a Provincial coroner who is acting on behalf of the Province of Ontario for further investigation or circumstances surrounding a death. The coroner’s authority overrules everyone – even the police. However, even the coroner does not have the right to direct your remains to a funeral service provider for the purpose of a funeral.
